Bank of England Names New Members to Enforcement Decision Making Committee
The Bank of England announced the appointment of Carlos Conceicao and Alexander Justham to its Enforcement Decision Making Committee (EDMC), with their terms scheduled to take effect in September 2026. The appointments were made following an external recruitment process.
The EDMC functions as the central bank's decision-making body for contested enforcement cases across statutory regimes operated by the Bank. These regimes include prudential regulation, financial market infrastructures, resolution, securitisation, wholesale cash distribution, critical third parties, and notes issuance.
While most disciplinary enforcement cases result in agreed outcomes between the Bank and the involved firm or individual, contested cases are referred to the EDMC. In these instances, the EDMC Chair convenes a panel consisting of three or more members to evaluate evidence, hear representations, and reach a decision. Committee members are appointed to five-year terms and may serve up to two terms.
David Roberts, Chair of the Court of the Bank of England, stated that Conceicao brings regulatory and enforcement experience from legal and regulatory backgrounds, while Justham provides practitioner experience for assessing complex cases.
Conceicao, a qualified solicitor and barrister, previously led the global regulatory disputes and investigations practice as a partner at Clifford Chance LLP from 2007 to 2025. His background includes work as a public service lawyer at the Financial Services Authority, a criminal barrister, and an appointment in January 2026 as a panel member of the Bar Tribunal and Adjudication Service.
Justham has worked in the financial services sector for more than 35 years across public and private roles. His past positions include chief executive officer of the London Stock Exchange, director of markets at the Financial Services Authority, and chief operating officer of UBS Wealth Management UK & Jersey. He has also served on the boards of the European Securities and Markets Authority and the Financial Conduct Authority's Practitioner Panel, and co-chaired the G-20 Iosco Task Force on Commodities.
